Supplying data to clients? How to become a recognised KVK partner

Businesses who buy data from the Business Register sometimes want to outsource this task. They then consult the Business Register indirectly through a recognised KVK partner. For instance, a service provider, service integrator, software supplier, or system integrator. By cooperating with recognised partners, KVK ensures a reliable Business Register, the privacy of those who are registered, and the correct use of data. Are you not a recognised KVK partner but do you supply Business Register data to others? If so, KVK cannot guarantee that your customers receive up-to-date information on which they can legally rely. Are you unable or unwilling to become a recognised KVK partner? Then, at the least, make sure that your use of Business Register data always complies with the standard KVK terms and conditions of use which apply to everyone. These state, among other things, that you must comply with all applicable regulations, such as privacy laws

What does it mean to be a recognised KVK partner?

As a recognised KVK partner, you may request Business Register products with public data for your clients. Institutions listed in the Money Laundering and Terrorist Financing (Prevention) Act (Wet ter voorkoming van witwassen en het financieren van terrorisme, WWFT), public authorities, and some professions may also request non-public and protected data.

KVK has made agreements with a number of recognised KVK partners containing terms of delivery. These protect the privacy of those registered. Clients of our partners can be sure that the quality of the data is legally sound.

KVK publishes an overview of recognised KVK partners. To make it clear that you are an approved partner of KVK, you may include a statement to that effect and place the KVK logo on your website.

As a partner, you must add customer and/or social value. A party that only benefits from KVK's name recognition and only resells the data for advertising revenue or commercial profit cannot become a service provider.

How do you use Business Register data?

You may only process Business Register data in accordance with the agreements you have made with your customer. To ensure this, you make a processing agreement with your customers that complies with Article 28 of the European General Data Protection Regulation (GDPR). And you agree with your customers that they will take into account companies that do not want to receive unsolicited advertising mail. Do you have audits of your business done? Then include these requirements for those.

Your customer determines and remains ultimately responsible for what happens to the Business Register data and what your role in it is. You act at the request of your customer who authorises you to do so.

What security requirements do I have to meet?

As a recognised KVK partner, you play an important role in the use of Business Register data, so it is important that your processes are in order. That is why KVK may ask you for a declaration or certification showing that you comply with the GDPR, including the ban on being able to search for natural persons (in Dutch). In the Business Register, you search only for legal entities, or businesses and organisations, and not natural persons. Only WWFT institutions, public authorities, and some professions are allowed to do so.

Can I use Business Register information in my own products and services?

You may also request Business Register data yourself in order, for instance, to develop and supply your own information products. You do not do this from your role as a recognised partner, but as a re-user of Business Register data. It is important that this re-use complies with applicable laws and regulations, such as the GDPR and the Dutch Re-use of Public Sector Information Act (Wet hergebruik overheidsinformatie, WHO, in Dutch) 

What if something changes in KVK's Business Register tasks?

Laws and regulations may change, and this may affect, among other things, KVK’s fees, access to data, or the method of delivery. KVK is aware that this has an impact on our partners. So, we communicate changes well in advance and have regular relationship discussions with our approved partners. During these talks, we always consider changes that may occur at KVK in the future.
