How do I register a foreign legal structure according to the Waadi Act?

If your foreign legal structure lends out workers in the Netherlands for payment, you will have to deal with the Dutch Workers Allocation by Intermediaries Act, (Waadi). This means you must register in the KVK Business Register, you need to fill in a number of forms. You send these by post to KVK. You do not need to make an appointment to visit.
What is the Dutch Workers Allocation by Intermediaries Act (Waadi)?
aims to reduce exploitation of workers. Do you have a company abroad and do you loan out staff or hire staff for payment or other remuneration? If so, the Waadi requires you to register the company in the KVK Business Register even if you do not have a branch in the Netherlands. There are conditions you must meet. You must also register posted workers through the online notification .
Which forms do I need for registration?
Download the forms below, fill them in, and send them by post. Each form states who may sign it and what proof you need to send with the form.
- Form 6: Registration Non-resident legal entity/company:
- For question 2.2, enter one of the following business activities in Dutch: uitzendbureau (employment agency), uitleenbureau (lending agency), banenpools (werkgelegenheidsprojecten) (job pools (employment projects)), or payrolling.
-Â For question 2.8, enter the address of the company abroad.
-Â Fill in the Dutch postal address at question 2.9 (this is not compulsory). - Form 11: Registration official of a legal entity.

Do I have to register my company with the Tax Administration?
No, KVK will notify the Netherlands Tax Administration. The Tax Administration decides in which country you must pay tax. You will be notified of this by post within 2 weeks of the start date.
How do I file a tax return?
If you must file your tax return in the Netherlands, you can do so via Mijn . To use this portal, you need to log in with . There is a fee to apply for an eHerkenning account.
Do I need to make an appointment at KVK?
No, that is not necessary. You send the forms by post to a KVK office. See how long it takes to process your registration. You will not receive any updates in between.
What happens after I have sent in the forms?
- After registration in the Business Register, you will receive a letter by post with your KVK number.
- You will also receive an invoice for the one-off registration fee by post.
- After registering, you can also order an extract from the Business Register. You use this as proof of registration.
- Is your start date in the future? Then we will register your company 1 week before the start date.
Frequently asked questions
